What constitutes sexual intercourse without consent?

http://www.bbc.co.uk/news/uk-england-27306426

What constitutes rape? It is sexual intercourse without consent. This should be decided by an jury consisting of  six married couples of good character. The details of the alleged rape will of course fall to be discussed. The jury will be invited to decide whether any reasonable person observing the events as described by the Prosecution and as admitted by the accused constituted sexual intercourse without consent.

Will the pussywhipped manginas of Britain in the legal profession even  dare to ask this question?
